Regulamin AVA AUTOSIGMA SRL

1. Definitions

The general terms and conditions of sale will apply to all goods and services sold by AVA AUTOSIGMA SRL through the online store Autosigma.ro, to the buyer.

2. Terms

  • Site – https://autosigma.ro
  • Content – all information found on this site, regardless of format.
  • Specifications – description of goods and services.
  • Seller – online storehttps://autosigma.ro
  • Buyer – natural or legal person who places an order for goods or services.
  • User – natural or legal person who, by creating an account on the site, agrees to the General Terms and Conditions.
  • Account – information about the user/buyer (identification data, orders, invoices, etc.) accessed by logging in with an email address and password.
  • Product - any tangible movable good
  • Order – the intention expressed by a potential comparator to purchase goods and services, through the site, in an electronic or telephone format.
  • Distance contract – GEO no. 34 of 2014 - any contract concluded between a professional/trader and a consumer within an organized distance sales or service provision system, without the simultaneous physical presence of the professional and the consumer, with the exclusive use of one or more means of distance communication, up to and including the moment the contract is concluded;
  • Service contract - any contract, other than a sales contract, under which the professional provides or undertakes to provide a service to the consumer, and the latter pays or undertakes to pay the price thereof;
  • Transaction – the collection or reimbursement of an amount resulting from the sale of a good or service to the buyer
  • Commercial guarantee - any commitment by the professional or a producer (hereinafter referred to as the guarantor) to the consumer, in addition to the legal obligations provided for in art. 5-14 of Law no. 449/2003 on the sale of products and the guarantees associated with them, republished, with subsequent amendments and completions, relating to the legal guarantee of conformity, to reimburse the price paid or to replace, repair or maintain the products in any way, if they do not comply with the specifications or any other requirement in the warranty statement or in the relevant advertising available at the time of or before the conclusion of the contract, the requirement not being related to conformity;

3. Registering an order

Registering an order through the autosigma.ro online store implies the potential buyer's agreement with the form of communication, by phone or e-mail, used by autosigma.ro.

An order can be applied for a good or service, from the offer on the site. A sales agent will take over the order to which a registration number has been assigned and will confirm the availability of the product after checking the stock. The delivery of the order will be made after informing the customer about the existence of the product, in the own stock or at the supplier (internal or external).

For products to be picked up from the seller's premises, they can be reserved for 72 hours (except Saturdays and Sundays and those officially declared non-working days) from the moment the order is placed.

The contract enters into force at the time of issuing the tax invoice to the buyer.

Product prices are valid 24 hours from their communication by AVA AUTOSIGMA SRL operators and in exceptional situations they may change during this period.

The prices of the products displayed on the site may undergo changes that will be communicated to the customer at the time of order confirmation.

Products are available within stock limits.

The seller reserves the right to cancel the customer's order in the event of a ridiculous or incorrect price displayed on the site, if due to a communication error the product can no longer be ordered or the delivery period exceeds a reasonable time limit, the customer's data is incorrect or incomplete, the customer's card transaction was not accepted by the bank.

4. Product delivery

The delivery time of the products is between 1 day and 60 days, depending on the availability in our own stock or at the internal or external supplier.

The seller will ensure the proper packaging of the products and the attachment of accompanying documents. He is discharged from the risks and responsibilities associated with the products, upon handover to the courier company.

Product delivery will be carried out through courier companies partnering with suppliers.

The seller does not authorize the courier to allow the buyer to open the package before signing for receipt (delivery) and paying for the value of the ordered products.

We recommend checking the packages received, not assuming responsibility for products damaged during transport, and drawing up a report of findings together with the courier company employee, if you find yourself in such a situation.

Loss or damage to the product after taking possession is not the responsibility of the seller or the courier.

The delivery of the products will be made from the company's own stock or from the suppliers' stock. If the purchased product or products are no longer available in the company's own stock, they will be delivered from the suppliers' stocks, which may result in an additional shipping cost, the value of which will be communicated to the customer. The products ordered from the suppliers' stock are received and checked at the AVA AUTOSIGMA SRL headquarters from where they will subsequently be shipped to the customer.

The products will be delivered only after order confirmation and customer acceptance of this new cost.

5. Rights and obligations of the seller / company

The seller is obliged to take the order from the customer, to confirm it by electronic means (e-mail, SMS) and/or by telephone.

The site owner reserves the right to modify or replace these terms without prior notice.

Autosigma.ro reserves the right to select its clientele, to close personal accounts, if there are attempts or suspicions of fraud, in the event of false personal information that prevents the execution of the sale-purchase contract, the use of abusive language in comments with the aim of defamation.

Autosigma.ro has the right to refuse customers with canceled orders and product returns, repeatedly.

6. Limitation of company liability

The information displayed on the site is for informational purposes only, the site owner not assuming responsibility for its accuracy or completeness.

Autosigma.ro will not be liable for direct, indirect, accidental damages, or other intangible losses resulting from: user behavior, inability to access the site, unauthorized access to customer data, actions of a third party on the site's services, in cases of negligence or crimes, failure to fulfill an order, product damage during transportation or any other technical problem.

During the delivery of products to the buyer, we are not responsible for the delay and integrity of packages delivered by courier companies, only for packages delivered by the company's couriers; in this regard, the buyer will be informed of any accidental situations that may occur during the delivery of the products.

The seller makes every effort to accurately inform the customer about the features and prices of the products and services displayed on the site. We reserve the right to cancel orders for products with ridiculous prices resulting from printing errors.

Promotions and special offers are valid while stocks last.

There is no guarantee that requirements will be met by purchasing a product or service from the site.

We assume no responsibility for the modification, interruption or suspension of the Autosigma.ro website.

Autosigma.ro carries out its product sales activity through the online store, in accordance with Romanian legislation.

7. Buyer's rights and obligations

Customers have the right to use the pages of the Autosigma.ro website exclusively at their own risk, to create an account, to modify or delete this account for specific reasons, to order products, respecting its Terms and Conditions.

When creating an account or placing an order, the potential comparator (user) is obliged not to provide false information and personal data, not to alienate the account and especially the password.

The customer can place an electronic order via the website or by phone, expressing his agreement with the Terms and Conditions of this website, thus accepting to receive the requested products and pay their value. He can cancel an order by email or by phone, before the products are delivered.

The buyer can post opinions regarding the purchased products, complaints are accepted only at the e-mail addresses mentioned on the contact page. Complaints will be resolved within a maximum of 30 days.

The buyer will not disclose to a third party or make public via the internet or media, the documents (offers, invoices, warranty certificates, minutes) or information received from the merchant/seller.

Minors may order products only with the consent of their legal representatives.

Only people residing in Romania can purchase products from this site.

The buyer may notify the seller for failure to fulfill contractual obligations.

8. Warranty

The warranty conditions are in accordance with GEO 140/2021 and the sellers' commercial policies.

The warranty of a product is valid from the moment of its delivery.

The products sold through Autosigma.ro are new, in the original manufacturer's packaging and are accompanied by a tax invoice and warranty certificate upon delivery. Also, both the price and the technical specifications do not represent any kind of contractual obligation, and may be changed without any prior notice. The product photos are for informational purposes only and there may be differences between them and the product itself.

Products sold by Autosigma.ro are delivered only after orders placed online, within the limits of available stocks. The prices of the products displayed on the site may be changed without prior notice.

The products sold by Autosigma SRL. are interchangeable with original parts according to the catalogs and lists edited by the manufacturers. The legal warranty is 24 months for long-term parts. Long-term parts are: clutches, springs, shock absorbers, planetary joints, body elements, steering elements, brake elements, lighting and signaling elements, cables, pumps, radiators, mufflers and exhaust pipes, bearings, spark plug wires, electric motor and alternator parts, moving engine parts.

For products such as discs, springs and shock absorbers, parts that are sold individually but are assembled as a set, the warranty is granted for both parts, not just one part.

The warranty covers material or manufacturing defects and the products that will present this type of defects will be replaced within the warranty period with new ones, according to the law. The warranty period runs from the date written on the sales invoice of the goods. The warranty period for Castrol products, if stored in their original packaging and at temperatures between -5 and +40 degrees Celsius, is 36 months.

AVA Autosigma SRL is exempt from liability regarding the warranty or it may be canceled in the following cases:

  • The parts were not installed in a repair shop authorized by the Romanian Auto Registry or by the vehicle manufacturer;
  • The parts have failed due to incorrect assembly or due to assembly together with worn, defective or modified related parts;
  • The part was used for a purpose other than that indicated in the manufacturer's catalog;
  • The part was not correctly identified as a result of the comparator presenting erroneous data or it was not compared during assembly with the part to be replaced;
  • The part has worn out due to overloading, incorrect or insufficient maintenance of the vehicle, failure to carry out periodic inspections according to the vehicle manufacturer's recommendations, the repair shop that performed the installation did not establish subsequent checks and adjustments according to the installation technology or imposed by the manufacturer;
  • The vehicle was used for purposes other than those intended by the manufacturer or was operated in inappropriate conditions;
  • The car was in an accident or suffered damage caused by external, atmospheric or other factors (thermal, electrical, mechanical shocks);
  • The pieces show signs of bumps, scratches, bends, ruptures, chemical or mechanical deformations;
  • The parts show normal wear.

The buyer who will claim a failure situation within the warranty period will present, together with the part(s) in question, the following documents:

  • The purchase invoice issued by AVA Autosigma srl and the tax receipt or invoice with which the buyer sold the part/parts in question to the end user;
  • The warranty certificate that was issued upon sale of the part;
  • Proof of installation in a repair shop authorized by the Romanian Auto Registry;
  • The document issued by the authorized repair shop stating the defect and explaining the causes of its occurrence;
  • Copy of the registration certificate of the vehicle in question;
  • Other documents required by the part supplier, etc.

The buyer may refuse the delivered goods if there are visible signs of damage or in case of improper functioning.

9. Returning products

According to GEO no. 34 of 2014, the consumer (natural person) benefits from a period of 14 days from the purchase to return a product, or a period of 14 days from the receipt of the last product delivered from a multiple product order, without having to justify the decision taken and without incurring any costs other than those provided for in art. 13 paragraph (3) and art. 14 of GEO no. 34/2014. In the case of services, withdrawal from the contract is made within 14 days from its conclusion.

Legal entity clients do not fall under the scope of Emergency Ordinance no. 34/2014.

The return of products purchased directly from the physical store is not subject to GEO no. 34/2014, as verification is required upon collection, the customer not having the right to terminate the contract within 14 calendar days. The purchased products can be returned after written notification to the seller. They will be returned together with a copy of the purchase invoice and the original warranty certificate.

The return is made via courier companies to the contact address, the shipping cost being borne by the customer.

Returned products must be in the same condition in which they were delivered (in the original packaging, with all accessories, with intact labels and accompanying documents).

Products that were delivered incorrectly and do not correspond to the order placed can be returned at no additional cost, with shipping fees being borne by Autosigma.ro, but reserving the right to choose the delivery method and courier company.

For products that are not functional or that have defects within the first 24 hours of use, you can return them within a maximum of 48 hours to be replaced with similar ones. If replacement is not possible, the value of the products will be refunded.

Packages received by courier with visible damage must be refused and a report will be drawn up together with the courier company representative specifying their condition.

Products cannot be returned in person to the registered office of Autosigma.ro.

We will reject repeated requests to return products, considering them abusive.

The following products cannot be returned:

  • without packaging, specific inscriptions and original content (accessories, documentation, cables and other materials included)
  • which are not in the original packaging in which they were delivered
  • lacking the original accessories and components delivered
  • that shows damage, with signs of wear, knocks, scratches, assembly, painting or welding
  • with interventions by unauthorized persons, with defects due to electrical or mechanical shocks
  • ordered incorrectly because the buyer did not provide the vehicle identification data and chassis series or these were communicated incorrectly
  • programmed modules, special parts manufactured for cars outside the European area, safety parts (e.g. airbags, seat belts), covers and coverings.
  • automotive fluids (engine oils, transmission oils, brake fluids, etc.)
  • packages that have the refund amount mentioned on the shipping label,
  • products brought under special conditions - which are not in the suppliers' stock and ordered at the express request of the buyer, in limited quantities or remanufactured and personalized products such as equipment and facilities.

10. Amount refunded

The refund of the value of the returned products will be made using the same payment method from the purchase transaction, without commissions, within 14 calendar days from the notification of the decision to withdraw from the contract. The amount will be refunded only after taking possession of the returned products. If you express your agreement for another method of refund of the amount, you will bear all related taxes and commissions. In the case of cash payments, the refund will be made to the customer's bank account.

11. Confidentiality and data protection

According to the requirements of Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, and of Law no. 506/2004 regarding the processing of personal data and the protection of privacy in the electronic communications sector, the Autosigma.ro store is obliged to manage the personal data provided by the user in a secure manner and only for the specified purposes.

By creating an account on the site, the customer expresses their consent for Autosigma.ro to manage their personal data, according to the law.

The purpose of collecting data is to use it when processing a delivery, for invoicing ordered products, marketing activities, social surveys or other purposes provided by law and the company's activity, only with the customer's voluntary consent.

According to Law no. 677/2001, the client benefits from the right of access, intervention on the data and the right to address the justice. At the same time, the client has the right to oppose the processing of personal data and to request their deletion.

Personal data will NOT be transmitted to third parties.

12. Intellectual property rights

The buyer understands the intellectual property rights. The site name, images, texts, symbols, web graphics, scripts, programs, cannot be processed, copied, published, used for personal or commercial purposes without the written consent of the owner who administers the site.

13. disputes

Disagreements regarding the execution of the sale-purchase contract are intended to be resolved amicably, otherwise, by appealing to the competent court at the trader's (seller's) headquarters.
