Regulamin EL-MAG AUTO SRL

These Website Regulations (“Regulations”) establish the terms and conditions for using the Polcar web catalog on the EL-MAG AUTO SRL website. By accessing and using the catalog, users agree to comply with these regulations.

1. General Provisions

1.1. The Polcar web catalog is an online platform accessible only to verified B2B customers of EL-MAG AUTO SRL.

1.2. The catalog displays Polcar’s product assortment, stock availability, and pricing as determined by EL-MAG AUTO SRL.

1.3. EL-MAG AUTO SRL is an authorized distributor of Polcar products in Romania, operating independently while using Polcar’s product database for sales purposes.

2. User Registration & Access

2.1. Access to the catalog is strictly limited to business customers registered with EL-MAG AUTO SRL.

2.2. Registration is by invitation only via a special link provided to verified business owners.

2.3. During registration, users must provide valid business information, including:

  • Company name
  • VAT number & business registration details
  • Contact person details (name, email, phone)

2.4. EL-MAG AUTO SRL reserves the right to approve, reject, or suspend user accounts at its discretion.

2.5. Registered users must maintain the confidentiality of their login credentials and are responsible for all activity on their account.

3. Product Availability & Orders

3.1. The catalog displays two types of stock availability:

  • Products in EL-MAG AUTO’s warehouse (available for immediate purchase).
  • Products in Polcar’s warehouse (available for order upon request).

3.2. Stock levels are regularly updated but may not reflect real-time availability. EL-MAG AUTO SRL does not guarantee continuous product availability.

3.3. Users must place orders through EL-MAG AUTO SRL; direct purchases from Polcar are not permitted.

3.4. Order confirmation is subject to stock verification and supplier approval.

4. Pricing & Payment

4.1. Prices displayed in the catalog include EL-MAG AUTO SRL’s markup on Polcar’s base pricing.

4.2. Prices are subject to change based on market conditions, currency fluctuations, or supplier adjustments.

4.3. The final price, including any applicable taxes, shipping fees, or discounts, will be confirmed at the time of order placement.

4.4. Payment terms (prepayment, credit, etc.) are agreed upon individually with each customer.

5. Delivery & Logistics

5.1. Delivery timeframes depend on product availability:

  • In-stock items are shipped within standard processing times.
  • Ordered items from Polcar’s warehouse are subject to Polcar’s shipping schedule and delivery policies.

5.2. Shipping costs and responsibilities (Incoterms) will be communicated before order confirmation.

5.3. EL-MAG AUTO SRL is not responsible for delays caused by logistics providers, customs clearance, or supplier processing times.

6. Returns & Warranty

6.1. Returns are only accepted for:

  • Defective products (as per manufacturer warranty).
  • Incorrectly supplied products due to EL-MAG AUTO SRL or supplier error.

6.2. Returns for custom-ordered or special items may not be accepted unless explicitly agreed.

6.3. Warranty claims will be processed according to Polcar’s official warranty terms and conditions.

7. Intellectual Property & Data Usage

7.1. The Polcar catalog, including images, descriptions, and product details, is proprietary information and may not be copied, distributed, or reproduced without authorization.

7.2. Users are granted access solely for business purposes related to purchasing through EL-MAG AUTO SRL.

7.3. Unauthorized use of catalog data, price manipulation, or disclosure to third parties is strictly prohibited.

8. User Conduct & Restrictions

8.1. Users must not:

  • Misuse, modify, or attempt to hack the catalog platform.
  • Share login credentials with unauthorized persons.
  • Place fraudulent orders or manipulate pricing data.
  • Engage in resale or redistribution of Polcar product information outside of authorized sales.

8.2. Violation of these rules may result in account suspension, termination, and legal action.

9. Limitation of Liability

9.1. EL-MAG AUTO SRL provides the catalog “as is” and does not guarantee uninterrupted access or error-free operation.

9.2. EL-MAG AUTO SRL is not responsible for:

  • Disruptions due to technical issues, supplier changes, or force majeure events.
  • Incorrect stock levels or pricing errors caused by system updates.
  • Any losses resulting from delays in product availability or delivery.

10. Amendments & Termination

10.1. EL-MAG AUTO SRL reserves the right to update these regulations at any time, with notice provided to registered users.

10.2. Any user who disagrees with changes may request account termination.

10.3. EL-MAG AUTO SRL reserves the right to suspend or terminate accounts for violations of these regulations.

11. Governing Law & Dispute Resolution

11.1. These Regulations are governed by Romanian law.

11.2. Any disputes will first be resolved amicably. If no resolution is reached, the matter will be settled in the courts of Romania.
